Terms of Service
These Terms of Service (“Terms”) govern your use of the Thotlink service (“Thotlink”), operated by Thotlink LLC, and the Thotlink mobile application (“the App”). Thotlink manages user accounts, installation identifiers, device labels, and communications.
The App itself runs locally on your device and stores your notes, images, and all other user-generated content only on your device. Thotlink LLC does not receive, store, or access any user-generated content created within the App.
By creating an account or using the App, you agree to these Terms.
1. Eligibility
Thotlink is intended for a general audience and is not specifically directed to children under the age of 13. By using the App, you represent that you are permitted to use the service under applicable law.
2. User Accounts
To use the App, you must create an account using a valid email address. Thotlink LLC receives and stores only the following information:
- Your email address
- A unique user ID
- A count of the number of times your account has been used to install the App on a device
- One or more optional device labels, if you choose to provide them, associated with individual devices on which the App is installed
If you have not yet been invited to use Thotlink, you may still download the App and submit your email to join the waitlist.
3. User-Generated Content (Stored Only on Your Device)
The App allows you to create notes and upload media. All such content is stored locally on your device. Thotlink LLC does not store, access, transmit, or back up this data.
You are solely responsible for managing, backing up, and securing your content.
4. Installations, Unique Installation IDs, and Device Labels
Each installation of the App associated with your account receives a unique installation identifier.
You may also provide an optional device label for each device (e.g., “My iPhone,” “Work iPad”). Thotlink LLC stores device labels solely for the purpose of enabling potential future optional backup or synchronization features.
Thotlink LLC does not currently store any content created within the App.
5. Email Communications
Thotlink LLC may send:
- Account-related emails
- Password reset emails
- Waitlist and invitation messages
- Optional service-related updates and announcements
All non-essential communications include an “Unsubscribe” link. Essential messages (e.g., password resets) cannot be unsubscribed.
6. Prohibited Conduct
You agree not to:
- Access or interfere with Thotlink systems in unauthorized ways
- Reverse-engineer the App
- Interfere with or disrupt service operations
- Use the App for unlawful purposes
7. Security
Thotlink LLC uses reasonable security measures to protect stored account-related data. Because Thotlink LLC does not store your App-generated content, the security of the data on your device is your responsibility.
8. Disclaimers
The App and Thotlink service are provided “as is,” without warranties of any kind. Thotlink LLC does not guarantee that:
- The App will be error-free
- Device failures or errors will not cause data loss
- Locally stored data will be recoverable
9. Limitation of Liability
To the maximum extent permitted by law, Thotlink LLC’s total liability for any claim arising out of or relating to your use of the App or service is limited to the total amount you paid to Thotlink LLC during the twelve (12) months before the claim. If you paid nothing, the limit is $0.
Thotlink LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of locally stored data.
10. Termination and Account Deletion
Thotlink LLC may suspend or terminate your access if you violate these Terms.
You may delete your account at any time from within the App. Upon account deletion, Thotlink LLC will permanently remove your email address, optional device labels, account identifier, and installation-tracking data from its systems. Deleting your account does not affect any content stored locally on your device.
11. Changes to These Terms
Thotlink LLC may update these Terms. If material changes occur, we will notify you via email or within the App.
12. Governing Law
These Terms are governed by the laws of the State of Georgia, excluding its conflict-of-law rules.
